Overview
De term homo sacer ontleent Agamben aan het Romeins recht, waar het een beschrijving is van hen waarover de Romeinen een ban hebben uitgesproken, de vogelvrijen. Ze zijn namelijk nog altijd in de ban van het rechtssysteem, omdat het rechtssysteem nog altijd invloed uitoefent op de homo sacer, zonder dat de homo sacer zelf een rechtssubject is. De soeverein ontleent zijn bestaan dus aan de ban, de macht om over insluiting en uitsluiting en leven en dood te beslissen.
