Overview
نتناول في هذا البحث حجية الحكم الجنائي النهائي أمام سلطات التأديب الإدارية بالجزائر وذلك بتسليط الضوء على مدى التزام سلطات التأديب بالأحكام الجنائية الصادرة بالإدانة، وعلى أثر الأحكام الجنائية الصادرة بالبراءة على سير الدعوى التأديبية. توصلنا إلى ضرورة التقيد بالأحكام الجنائية الصادرة بالبراءة لانتفاء الوجود المادي للوقائع، وتلك الصادرة بالبراءة للشك في الأدلة، و مع ذلك يجوز لجهات التأديب عقاب الموظف العام عن مخالفة مسلكية أخرى غير تلك التي برئ منها جنائيا، بأن وضع نفسه موضع الشبهات متى قام موجب لها.
