إن القرار الإداري أحد الأعمال القانونية التي تصدرها الإدارة، إضافة للعقد الإداري، فالقرار الإداري وإن كان عمل إداري إرادي، فهو لا يخرج عن كونه يصدر تنفيذا للقانون، باعتباره صادرا من السلطة التنفيذية صاحبة هذا الاختصاص. كما أنه لا يمكن اعتبار كل ما يصدر عن الإدارة قرار إداري بالصفة أعلاه في هذا الأخير.
