السجن عقوبة من العقوبات التي شرعها الإسلام إما لردع الجاني عن الجريمة أو تهذيبا له، أو لرد حقوق الناس، وهو عقوبة تعزيرية، ولكنه لا ينوب عن إقامة الحدود الشرعية التي ورد ذكرها في القرآن الكريم والسنة النبوية... وهي الزنا، والقذف، وشرب المسكر، والسرقة، والحرابة، والبغي، والردة، وأيضا القتل العمد الموجب للقصاص. ويرتكز البحث على بيان فضل الشريعة الإسلامية في التفريد في العقاب وتطبيق عقوبة السجن عبر العصر الإسلامي.
