يعد الاستثمار الأجنبي أحد اهم الظواهر التي تسود عالمنا اليوم فقد أخذت بوادر المنافسة على جلب الاستثمارات الأجنبية نتيجة للدور الكبير الذي يلعبه الاستثمار الأجنبي في تحقيق التنمية الشاملة والدائمة فدخلت الدول في سباق لتحسين بيئتها الاستثمارية من خلال منح المستثمرين الأجانب جملة من الإعفاءات والضمانات، أن أي نظام قانوني يمكن أن تنشأ فيه منازعات بين أطرافه وهذا أيضا موجود في العلاقة الاستثمارية بين الدولة المضيفة والمستثمرين الأجانب. والحماية القانونية تعمل على جذب تلك الاستثمارات، لذا حاولنا دراستها في مبحثين، خصصنا الأول للتعريف وتناولنا في الثاني وسائل الحماية.
