Overview
عند دراستنا للقانون رقم: 08/14 المؤرخ في 20 جويلية 2008 المعدل والمتمم للقانون رقم: 90/30 المتضمن قانون الأملاك الوطنية الجزائري، لاحظنا أن أهم ما جاء في هذا التعديل أنه أضاف نوعا جديدا من عقود الامتياز لم يكن يعرفها النظام القانوني الجزائري من قبل، فبعدما نص أن عقود الامتياز تشمل إما استغلال ملك عمومي أو تمويل أو استغلال منشأة عمومية، تطرق إلى إمكانية بناء منشأة تعود عند نهاية مدة الامتياز إلى السلطة مانحة الامتياز. وعليه نلاحظ أن قانون الأملاك الوطنية المعدل ضم نوعا جديدا من عقود الامتياز وهو ما يسمى عقود البناء والتشغيل ونقل الملكية وقد توصلت الدراسة إلى استخلاص مزايا وعيوب عقود البوت (B.O.T).
