Overview
إن الهدف الرئيسي من إخضاع الدولة للقانون هو تأمين الحماية لحقوق وحريات الأفراد ضد تعسف السلطات العامة، ويختلف مضمون هذه الحقوق حسب النمط السياسي المتبع، والتطور التاريخي للدولة. من أجل ذلك فإن الدولة التي لا تعترف بحقوق وحريات الأفراد، أو لا تكفلها ولا تعمل على حمايتها لا يمكن أن يعترف لها بصفة الدولة القانونية، لأن مبدأ الدولة القانونية لم يوجد إلا لضمان وحماية الحقوق والحريات العامة، وكفالة تمتع الأفراد بها.
