الحجز التحفظي على عقار في التشريع الجزائري

Overview
تهدف هذه الدراسة إلى تحليل نصوص قانون الإجراءات المدنية والإدارية المتعلقة بالحجز التحفظي، والبحث عن مدى كفايتها لحماية حقوق الدائن والمدين، باعتبار أن الحجز التحفظي هو من أهم الوسائل التي شرعها القانون للدائن من أجل الحفاظ على أموال المدين. يلاحظ أنه إذا كانت نصوص القانون رقم 08-09 المتضمن قانون الإجراءات المدنية والإدارية، قد جاءت مفصلة بالنسبة للحجز التحفظي على المنقول، فإن المشرع لم يعطي أحكاما خاصة للحجز التحفظي الواقع على العقار، بل جاءت أحكاما مشتركة تحكم صنفي الأموال معا، وهو ما يقتضي مراجعة وتحديثا.
