سعت الدراسة للتعرف على دور الإرادة في إبرام العقد الطبي. اقتضى العرض المنهجي للدراسة تقسيمه إلى مبحثين، تناول الأول حرية الطبيب في اختيار مرضاه والاستثناءات الواردة عليها، وفيه مطلبين هما حرية الطبيب في اختيار مرضاه، الاستثناءات الواردة على حرية الطبيب في اختيار مرضاه. تطرق المبحث الثاني إلى حرية المريض في اختيار طبيبه والاستثناءات الواردة عليها، وفيه مطلبين هما حرية المريض في اختيار طبيبه، الاستثناءات الواردة على حرية المريض في اختيار طبيبه. اختتمت الدراسة بالإشارة إلى أن العقد الطبي هي صورة علاقة عقدية تربط الطبيب بالمريض، فهو يصدر من الطريفين من المريض الذي يختار طبيبه ومن الطبيب الذي يوافق على مريضه. كُتب هذا المستخلص من قِبل المنظومة 2022
