Overview
تهدف هاته الدراسة إلى بيان خصوصية دعوى مسؤولية الناقل في عقد النقل البري للبضائع. ولقد توصلنا إلى أن هاته الدعوى تخضع للقواعد التي تسري على دعاوى المسؤولية التعاقدية، إلا أن المشرع قد خصها ببعض الأحكام التي تختلف عن القواعد العامة في دعاوى المسؤولية العقدية، حيث أنه يمكن إسقاطها من طرف الناقل عن طريق الدفع بعدم القبول متى توافرت شروطه، كما يمكن إسقاطها عن طريق التقادم السنوي والمقدر بسنة وليس عن طريق التقادم المعروف في القواعد العامة والمقدر بخمسة عشرة سنة.
