Overview
إن التزاحم في أسباب كسب الملكية فكرة إيجابية ناطقة، وليست فكرة سلبية صامتة، فلكي تتحقق لابد من تحقق شروط وعناصر معينة، وبعدم وجود هذه العناصر والشروط لا يمكن لهذه الفكرة أن تتحقق في البين. وتقوم فكرة التزاحم في أسباب كسب الملكية على مجموعة الشروط الجوهرية في تكوينها والتي يمكن استخلاصها من موارد مثل هذا النوع من التزاحم، وتختلف هذه الشروط بينها تبعا لاختلاف ذاتها. فمنها ما يتسم بطابع شخصي يرجع إلى من توفر فيه سبب كسب الملكية، ومنها ما يتصف بصبغة موضوعية وهي إما ترجع لمحل التزاحم أو ترجع إلى الرابط الموضوعي بين المقوم الشخصي وبين محل التزاحم
