Overview
تتجه معظم التشريعات المنظمة للتحكيم إلى وضع بعض الشروط التي يجب توافرها في من يتولى مهمة التحكيم، كما يجب توافر هذه الشروط سواء تم تعيين المحكم من قبل الأطراف، أو من طرف القضاء، أو من طرف مركز التحكيم. وإلى جانب الشروط القانونية الواجب توافرها في الهيئة التحكيمية في جميع حالات التحكيم نجد أن للأطراف حرية فرض شروط ومواصفات معينة في من يرشح للقيام بمهمة التحكيم، هذه الشروط قد تختلف من حالة إلى أخرى بحسب الملابسات الخاصة بكل تحكيم على حدة.
