Overview
إن من أهم وأبرز الصعوبات التي تواجه التنظيم القانوني للمسؤولية المدنية للناشر الإلكتروني هي طبيعة تلك المواقع الإلكترونية ما تتمتع به من خصوصية حيث يستطيع الناشر الإلكتروني استخدام الأسماء الوهمية والمستعارة في منشوراتهم عبر المواقع، وكذلك الخصوصية التي تمنح لهم داخل المواقع الإلكترونية حيث يمكن تفعيل برامج تؤدي إلى صعوبة الوصول إلى بياناتهم الشخصية، وتعد من أهم الصعوبات هي التخلف التشريعي وجموده وعدم مواكبة التقدم الحاصل في هذا المجال وإغفال وقوع الخطأ في هذا الإطار حيث يلزم الأمر وجود نصوص قانونية تتعلق بالنشر الإلكتروني، حيث أن القواعد العامة تعد غير كافية لشرح الحالات القانونية التي تواجه النشر عبر المواقع الإلكترونية.
