يهدف المقال إلى قراءة في عضوية تشكيلة مؤسسة الاجتهاد الدستوري في ظل التعديل الجديد 2020، وبحث مدى إرساء المؤسس الدستوري لضمان الاستقلالية والحيادية والنزاهة داخل المؤسسة. وتم التوصل إلى أن المؤسس الدستوري وفق لحد ما لإرساء وتحقيق ذلك من خلال استحداث شروط في عضوية التشكيلة؛ تسهم في إبعاد أي تأثيرات خارجية على الآراء والقرارات التي يتخذها أعضاء مؤسسة الاجتهاد الدستوري، ولكن لتكتمل هذه الاستقلالية يتم التأكيد على ضرورة تفعيل بعض الاقتراحات التي تم التوصل إليها على ضوء جملة من النتائج.
