Overview
للشهادة دور مهم في مجال الإثبات، وقد احتلت نطاقا واسعا في القانون رغم العيوب التي قد تعتريها ورغم أنها قد تؤدي إلى تضليل العدالة، فكان للقاضي مطلق الحرية في الأخذ أو رفض الأخذ بشهادة الشهود كدليل إثبات حسبما يطمئن له ويراه من ظروف الدعوى، على أن يكون عدم اطمئنانه سائغا عقلا. وقد حدد المشرع قوة الشهادة وجعلها ذات حجية غير ملزمة متروكة لقناعة القاضي الذي له السلطة الواسعة في تقديرها، ولا رقابة عليه من المحكمة العليا في ذلك.
