Overview
شغل الإرث جانباً مهماً من حياة العرب قبيل الإسلام ، وكان توزيعه يختلف ما بين المجتمع الحضري والمجتمع البدوي ، ففي المجتمع الحضري كان الإرث يوزع على وفق قانون يمثل وجهه نظر الدولة كالتشريعات التي صدرت في وادي الرافدين مثل : أور - نمو، واشنونا ، وحمورابي . اما في المجتمع البدوي فانه يتم على وفق الأعراف والتقاليد القبلية . وكان مقبولاً في المجتمع القبلي على الرغم مما يلحقه من أضرار في حياة بعض شرائح المجتمع ، وظل كذلك حتى مجي الإسلام الذي حدده ونظم توزيعه على وفق أسس ثابتة ومقبولة ، وضمن للجميع الحق في التركة دون تمييز .
