Overview
يكاد لا يخلو أي تصرف حكومي من تضمنه لأقضيه متعلقة بسياسة عامة، ولا تسن أي سياسة عامة دون ضوابط إجرائية وإدارية ونظامية، وفى الغالب تكون ممنهجة ومدونة ولو جزئياً. أما الضوابط الشرعية، ففي الغالب، يكتفى فيها بظاهر الجانب الفقهي؛ أي بالحكم الشرعي العام على موضوع السياسة العامة، وتكاد لا تفعل ضوابط السياسة الشرعية المتعلقة بالمصلحة أو التوازنات المصلحية، ويكاد لا يوجد ربط بين السياسة العامة والسياسة الشرعية عند سن السياسات؛ لأجل ذلك سنتطرق باختصار في هذه الدراسة إلى بيان وتعريف السياسة العامة من منظور وتعريف السياسة الشرعية، ثم نتناول بيان الضوابط الشرعية والإدارية والإجرائية، بالإضافة إلى أسباب تضارب السياسات، مع التمثيل لذلك من واقع أنظمة التأمين التعاوني.
