Overview
يقوم إبرام اتفاق التحكيم على مبدأ التراضي بين الدولة أو أية مؤسسة تابعة لها من جهة وبين المستثمر الأجنبي من جهة أخرى، على أن يكون محل اتفاق التحكيم محددا وفي شكل مكتوب. وأمام التطورات الحاصلة على مستوى العلاقات الاقتصادية الدولية مما اثر على الحصانة السيادية للدولة، وأدى ذلك إلى تحول الحصانة القضائية والتنفيذية المطلقة إلى نسبية لاسيما في عقود التنمية الاقتصادية مع مستثمرين أجانب، ومثالـه عقـود الاستثمار البترولية من اجل تنمية مصادر الثروة الطبيعية.
