Overview
هدفت هذه الدراسة إلى تسليط الضوء على مفهوم الفضالة في الفقه الإسلامي وذلك من حيث تعريفها لغة واصطلاحا، وما قاله الفقهاء في حكمها والشروط الواجب توافرها فيها، وما هي الأدلة التي استند عليها من جوزها، ثم كيفية إجازة عندما يكون العقد معها موقوف النفاذ، كما تناول البحث مفهوم الفضالة في القانون وما هي الأركان التي يجب توافرها حتى يصح العقد، وأخيرا اشتملت الدراسة على أهم النتائج وأبرز التوصيات.
