Overview
يمارس رئيس الجمهورية سلطة التشريع إستثناءا في عدة حالات، ومنها سلطة إصدار قانون المالية بموجب أمر في حالة عدم مصادقة البرلمان (كمختص أصيل بالعمل التشريعي) بغرفتيه على مشروع قانون المالية المعروض عليه من طرف الحكومة، في الآجال المحددة دستوريا والمقدرة بخمسة وسبعين 75 يوماً، في نص المادة 120 من دستور 1996 والمقابلة لها المادة 138 من التعديل الدستوري لسنة 2016، ولم تأتي هذه الآلية على إطلاقها بالنسبة لرئيس الجمهورية بل تحكمها عدة شروط وقيود، أوردها المؤسس الدستوري كضوابط عند ممارسته لسلطة إصدار قانون المالية بموجب أمر.
