Die Entscheidung des BGH dreht sich um die objektiven und subjektiven Voraussetzungen eines strafbefreienden Rücktritts vom Versuch gemäß § 24 Abs. 1 Var. 2 (Verhinderung der Tatvollendung). Till Mengler (JZ 2019, 949) kritisiert das Urteil hinsichtlich der subjektiven Voraussetzungen eines solchen Rücktritts und sieht insoweit eine Abweichung von der bisherigen Rechtsprechung.
