Overview
In dem Beschluss über die Fortdauer der Untersuchungshaft des Beschuldigten setzt sich der BGH zum ersten Mal ausführlicher mit der Vorgesetztenverantwortlichkeit gemäß § 4 VStGB auseinander. Christoph Safferling (JZ 2010, 965) stimmt der Entscheidung zu, die hinsichtlich der Kenntnis des Befehlshabers von den einzelnen Taten Untergebener die Anforderungen im Vergleich zu den allgemeinen Regeln herabsetzt.
