Mehr als 70 Jahre nach der Befreiung des Konzentrationslagers Auschwitz bestätigt der BGH die Verurteilung eines ehemaligen SS-Angehörigen durch das LG Lüneburg wegen Beihilfe zum Mord in 300.000 Fällen. Christoph Safferling (JZ 2017, 258) zeichnet kritisch die Geschichte der Gesetzgebung und Rechtsprechung zur Beihilfestrafbarkeit von NS-Verbrechen nach und analysiert die Entscheidung, deren Begründung zwar ein Schritt in die richtige Richtung, dogmatisch und argumentativ aber nur teilweise überzeugend sei.
