Overview
لم يكن لدى العرب قبل الإسلام نظام قضائي بالمعنى المتعارف عليه إنما كانت لهم أعراف وتقاليد خاصة بهم، وقد صاحب هذا الأمر كثرة الجرائم التي انتشرت في أنحاء واسعة من شبه الجزيرة العربية، ولا يخلو أي مجتمع منها، فهي آفة تشكل خطرا على امنه واستقراره، ولم يكن بمقدور العرب الحد منها لعدم وجود حكومة مركزية في البادية، مما خلق جوا من عدم الاطمئنان والتخوف لدى أكثر القبائل العربية، لذا كان لزاما على ذوي المجني عليه أن يتحروا على الجريمة التي وقعت عليهم بأنفسهم لعدم وجود سلطة مركزية تهتم بذلك فيقومون بتوجيه اتهاماتهم لمن يشكون بهم، وممن لهم عداوة معهم.
