Overview
El artículo presenta un análisis de la tensión jurídica provocada por la urbanización informal en relación con los derechos a la propiedad y la vivienda en Colombia. En torno a dicha disputa se describe la forma como la jurisdicción constitucional colombiana ha dado respuesta al fenómeno. Se sostiene que el juez se enfrenta a una difícil situación en estos eventos, derivada de la ausencia de una política pública habitacional eficaz para los sectores de menores ingresos. Ello ha conducido a un activismo judicial materializado en decisiones que oscilan entre una fuerte intervención en las funciones administrativas del gobierno y la dilación del efectivo cumplimiento de derechos constitucionales. En contraste, parecen ausentes decisiones que contribuyan a encontrar soluciones estructurales al problema.
