In the legal brief he filed with the U.S. Supreme Court on behalf of Homer Plessy inPlessy v. Ferguson, Albion Tourgée—the former North Carolina judge and author of numerous novels of Reconstruction—asserted that Plessy’s reputation as a white man constituted a form of property, and that this property had been forcibly taken from him when he was ejected from a white railroad car.
