Joseph Conte, 28, of 4172 Manchester St., is charged with one count each of driving under the influence of alcohol or controlled substance, open lewdness, accidents involving damage to attended vehicle or property, driving without a valid driver's license and other traffic violations, according to charging documents. Conte admitted to drinking \"a few beers\" prior to the crash, according to charging documents. PennDOT records showed Conte's driver's license was expired, police said.

Conte handed down a 12-page decision this week that determined the commission violated the terms of its lease with Lodi by increasing the borough's water rates first by 25 percent in 2009 and then by 29 percent in 2010 -- a dramatic hike that Conte's ruling said \"shocks the conscience of a reasonable person.\" \"We're a specific customer, you can't charge us like you charge your other customers,\" said Lodi's attorney, Alan Spiniello. \"It was a David and Goliath kind of thing,\" Borough Manager Tony Luna said. \"People told us you can never win it, you're taking on a big conglomerate. ... It serves notice on the big conglomerates that you can't just do what you want.\"

[Joseph Conte] wrote in the Jan. 3 opinion that he was \"troubled by the fact that there was no deliberative discussion at the hearing, which was followed by a rushed motion of the chairman and then a vote of approval on the application.\" \"We were able to fight City Hall, which nobody has even attempted,\" said Debra Duffy, a co-founder of the association who filed the lawsuit with residents Susan Brauer, Patricia O'Dowd and Charles Park. The association raised $10,000 from residents for the case. The zoning board met on Jan. 25, 2010, and heard from the Dream USA's planning witness but denied a request by residents that the board retain a traffic engineer. Board Chairman Michael Pollotta then moved to approve the application, and the board voted 5-0 in favor.

Conte upholds the Board of Adjustment's decision. Nov. 26, 2009: The Board of Adjustment approves Pilot's application, with conditions, including the closing the Ridge Road entrance, prohibiting the sale of adult magazines and eliminating overnight parking.

Critics of pumping station lose injunction bid

Judge Joseph S. Conte denied the group's request Thursday, saying that the time was \"not ripe\" for an injunction, William I. Strasser, Montvale Cares' attorney, said Thursday. \"It was the judge's position that it was not ripe for the stay,\" Strasser said. \"It was basically premature.\" Conte reversed the zoning board's decision on Dec. 8, saying that the planned use was inherently beneficial, and that the board acted arbitrarily and capriciously when it denied the application. Conte granted the company the variance and sent the application back to the zoning board for site plan approval.

The board initially denied the company's 2007 application for the use variance in November 2008. United Water then sued in Superior Court and filed a petition with the state Board of Public Utilities. [Joseph Conte], who sits in Hackensack, sided with the utility, saying, among other things, that the facility was inherently beneficial. Conte remanded the rest of the application to the board for further hearing. In a letter to board secretary Lorraine Hutter on Jan. 28, United Water's attorney, Daniel Y. Gielchinsky, said the application was an \"as-of-right\" application and must be granted. He also recommended that the board obtain testimony from the noise consultant about the new building's location and the noise reduction recommendations; the size of the trucks that would be on the property to maintain the pumps and whether they would be able to navigate the driveway; and how secondary containment systems would reduce the chance of a sodium hypochlorite spill. Sodium hypochlorite is a bleaching agent and disinfectant.

Judge won't stop hearings on Pilot truck-stop project ; Suit alleges officials have conflict

The Bergen County public advocate and a lawyer for Paks Service Inc., which owns a gas station on Route 17, tried to stop the hearings until state Superior Court Judge Joseph S. Conte rules on lawsuits filed earlier this month. Pilot, which wants to modernize and expand a truck stop on Route 17 south, granted an extension this week allowing the hearings to continue even though they have stretched beyond the 120-day limit that an applicant has to wait for a decision from a board. Joseph M. Ariyan, public advocate for land use for Bergen County, said, \"We're going to take all the steps necessary to ensure the proceedings in Mahwah are done fairly and to ensure the interests of the citizens of Bergen County are [considered].\"

[Joseph Conte] ordered that Wood remain held on $125,000 bail. He also forbade her to have any contact - in person, by telephone, or by mail - with her husband, 62-year-old Zlatko Wood, whom authorities say she wanted dead. Wood is accused of trying to hire a hit man to kill her husband by pushing him into the path of a train and making the death appear accidental, authorities said on Tuesday shortly after her arrest. They said she offered him half of a $50,000 life insurance policy once he completed the killing. She is charged with conspiracy to commit murder.

Because he used a firearm to commit the crime, Kyong Man Lee must serve at least five years before he becomes eligible for parole. He was sentenced by Superior Court Judge Joseph S. Conte in Hackensack. In his request for a lighter sentence, [Vincent Basile] asked Conte to consider Lee's cooperation with authorities and the fact that he had no criminal record prior to this arrest. He suggested a sentence in the 10- to 12-year range.
